Terms of Service

Agreement

These Terms of Service ("Terms") are a legal agreement between you and Atelier List Inc. ("Atelier List", "we", "us"). By creating an Atelier List account or using the service, you agree to these Terms. If you don't agree, don't use Atelier List.

Who can use Atelier List

Atelier List is available to licensed real estate agents and brokers in the United States. By creating an account you represent that:

• You hold a valid real estate license in your state
• You are at least 18 years old
• You have the authority to enter into this agreement on behalf of yourself or your brokerage

We reserve the right to verify licensure and to suspend accounts that cannot be verified.

What Atelier List provides

Atelier List provides a private platform for real estate agents to:

• Create and manage off-market and pre-market listing pages
• Organize listings into password-protected lists for specific buyers
• Receive inbound buyer inquiries via a dedicated SMS number (your Pocket Line)
• Collaborate with other agents through private groups

Atelier List is a tool, not a brokerage. We do not participate in, facilitate, or take any commission on transactions. Any deal that results from activity on Pocket is solely between you and your client.

Your content

You own your listings, photos, notes, and any other content you create on Atelier List. You grant us a limited license to store, display, and transmit that content solely to operate the service on your behalf.

You are responsible for ensuring that any listing you publish on Pocket complies with all applicable laws, MLS rules, fair housing regulations, and your brokerage's policies. Pocket does not review listings before publication.

Acceptable use

You agree not to use Pocket to:

• Publish listings you do not have authorization to market
• Violate fair housing laws or discriminate against any protected class
• Spam or harass buyers or other agents
• Scrape, reverse-engineer, or attempt to extract data from the platform
• Circumvent authentication, access controls, or security measures
• Use the platform for any unlawful purpose

We may suspend or terminate accounts that violate these rules at our sole discretion.

Buyer access

When you share a list link and password with a buyer, you are responsible for:

• Ensuring you have a legitimate, existing relationship with that buyer
• Not sharing list credentials publicly or with unintended recipients
• Complying with any applicable disclosure obligations before sharing listing information

Buyers who access your lists do not become users of Atelier List. They have no account and no agreement with us. Your relationship with your buyers is your own.

SMS and communications

Your Pocket Line is a dedicated number provisioned through Twilio. By using the Pocket Line feature you agree to:

• Use it only for legitimate real estate communications
• Not use it to send unsolicited commercial messages
• Comply with applicable telemarketing and SMS regulations (TCPA and similar)

Standard message and data rates may apply to your buyers depending on their carrier.

Fees and payment

Pocket is currently available by invitation only. Pricing details are communicated at account setup. We reserve the right to introduce or change fees with 30 days' notice. If you disagree with a fee change, you may cancel your account before the change takes effect.

Termination

You may cancel your account at any time by contacting us at hello@pocketrealty.com. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the service. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Disclaimers

Pocket is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that listing data will be free from loss. You are responsible for maintaining backups of content that matters to you.

Pocket is not a licensed real estate broker and provides no legal, financial, or transactional advice.

Limitation of liability

To the fullest extent permitted by law, Pocket's total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

Changes to these Terms

We may update these Terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Continued use of Pocket after that date constitutes acceptance of the updated Terms.
